Moss is operated by Moss New York, LLC. Membership and eligibility Membership is available only to individuals 18 years of age or older who meet Moss's membership criteria. Accounts A member is responsible for the accuracy of the information on their account and for keeping their sign-in credentials secure. Reservations and events Reservations and event registrations made through Moss are subject to the availability, cancellation, and no-show policies posted at the time of booking. Member conduct A member agrees to treat Moss staff, partner venues, and other members with respect, and not to use the service for any unlawful purpose. SMS / Text Messaging Program Program. The Moss Messaging Program is operated by Moss New York, LLC. Messages may be sent using third-party technology providers on Moss's behalf. Opting in. A member opts in by entering a mobile number on the Moss application or sign-in page, where the SMS disclosure is shown below the phone field, and pressing Send code. Consent to receive texts is not a condition of membership or of any purchase. Messages you may receive. Replies from Moss staff to requests you send, reservation and event confirmations and reminders, and time-sensitive club notices. Frequency and costs. Message frequency varies. Message and data rates may apply. Opting out. Reply STOP to cancel at any time (CANCEL, END, QUIT, and UNSUBSCRIBE also work). You will receive one confirmation message and no further texts unless you opt in again. Help. Reply HELP for help, or email support@dorsia.com. Carriers. Carriers are not liable for delayed or undelivered messages. Privacy. See our Privacy Policy at xyz.moss.nyc/privacy-policy. Intellectual property Everything on Moss's website and app, including its name, logo, and design, belongs to Elomi Corporation or its licensors and may not be used without permission. Disclaimers Moss is provided "as is," without warranties of any kind, to the fullest extent permitted by law. Limitation of liability To the fullest extent permitted by law, Elomi Corporation is not liable for indirect, incidental, or consequential damages arising from a member's use of Moss. Governing law These Terms & Conditions are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Changes to these terms Elomi Corporation may update these Terms & Conditions from time to time. The date at the top of this page shows when it was last revised.
